Time is important in mediations. There are different stages in every mediation that need to be worked through; exploring issues, understanding the other sides wants and needs and explaining yours, moving from the emotional to the rational, considering options, moving to the deal, negotiating the details. It all takes time. Sometimes one party becomes stuck on a particular issue. To that person it is important and that needs to be respected. However, looked at more objectively it may be a small part of what needs to be agreed. At the end of the day the parties attend mediation to reach a settlement. One of the tasks of the mediator is of course to keep things moving but the parties and their lawyers also need to take responsibility for making sure that the time available is used efficiently.
